Possession of a gambling device. Class A misdemeanor.
Meaning, a person who participates in any form of gambling merely as a contestant or bettor, without receiving or giving the right to receive any profit thereof other than personal gambling winnings, and without otherwise rendering any material assistance to the establishment, conduct or operation of the particular gambling activity.
Poker is gambling, but still not gambling, it is game of skill. Truly the legal clauses seem to be a lot confusing when it comes to reading them against exceptions, but this confusion has favored with poker being able to be organized legally.
